Frequently Asked Questions

Yes. Creating or altering a basement to establish a new dwelling unit generally requires a building permit. The permit drawings need to demonstrate compliance with the applicable Ontario Building Code requirements, which can include fire separations, exits and egress windows, ceiling heights, stairs, plumbing, heating and ventilation, electrical coordination, and energy-efficiency requirements. Municipal zoning requirements must also be satisfied before the project can proceed.
A typical secondary-suite permit drawing package can include an existing and proposed floor plan, site plan where required, building sections, construction details, fire-separation details, egress-window information, door and window schedules, room dimensions, ceiling heights, and applicable code information. The exact drawing and documentation requirements depend on the scope of work, existing conditions, and the municipality reviewing the application.
A secondary suite must meet applicable zoning and building requirements. Depending on the property and proposed work, this can involve requirements for independent access, fire and sound separation, exits or egress windows, ceiling heights, stairs, smoke and carbon-monoxide alarms, plumbing, heating and ventilation, and other life-safety provisions. The requirements should be assessed based on the specific existing house rather than assuming that every basement can be legalized using the same design.
Potentially. An existing basement may be able to be brought into compliance through alterations, but this depends on its current construction, the original building configuration, zoning, and the deficiencies identified during the design and permit review. Existing conditions should be documented first so that the required upgrades can be identified before preparing the final permit drawings. A permit application does not automatically legalize an existing unapproved suite.
